By accessing, browsing, booking, purchasing or otherwise using the 2nd LANE website and services, you agree to be bound by these Terms and Conditions. If you do not agree with these Terms, you must not use our website or services.
1. About 2nd LANE
2nd LANE provides luxury designer skiwear rental services within Australia. These Terms apply to all website use, rental bookings, in-person appointments, product hire, delivery, returns, payments and communications with 2nd LANE.
2. Definitions
In these Terms:
“2nd LANE”, “we”, “us” or “our” means 2nd LANE, ABN 78 76 3103271.
“Customer”, “Client”, “User”, “you” or “your” means any person who accesses the website, creates an account, places a booking or uses our services.
“Product”, “Item” or “Garment” means any clothing, accessory, footwear or other item made available for rental by 2nd LANE.
“Booking” or “Rental Booking” means a confirmed request to rent one or more Products for a selected rental period.
“Rental Period” means the agreed period during which the Product is reserved for you and/or in your possession.
“Return Date” means the final date on which the Product must be returned, posted or delivered back to 2nd LANE.
“Rental Fee” means the amount charged for hiring a Product for the selected Rental Period.
“RRP” means the recommended retail price, replacement value or comparable retail value of the Product as determined by 2nd LANE.
“Late Fee” means any fee charged when a Product is not returned by the required Return Date.
“Security Bond” means a refundable deposit that may be required for selected bookings or Products.
“Damage Cover” or “Insurance” means optional limited cover offered by 2nd LANE for certain accidental damage, subject to these Terms.
3. Legal Capacity
By placing a booking, you confirm that you are at least 18 years old or have the consent of a parent or guardian. You also confirm that all information provided to 2nd LANE is true, accurate and complete.
4. Account and Customer Information
You may be required to create an account or provide personal information to complete a booking. You agree to provide accurate and current information, including your full name, phone number, email address, billing address and delivery address.
You are responsible for maintaining the confidentiality of your account details and for all activity that occurs under your account.
2nd LANE may refuse, cancel or restrict a booking where information is incomplete, inaccurate, suspicious or inconsistent with these Terms.
5. Identity Verification and Rental Agreement
As 2nd LANE rents high-value luxury garments, we may require identity verification before releasing any Product. This may include requesting a valid photo ID, proof of address, phone number, signed rental agreement or other reasonable verification.
By placing a booking and agreeing to these Terms at checkout, you enter into a legally binding rental agreement with 2nd LANE.
Failure to provide requested verification may result in cancellation of your booking. In such circumstances, any refund or credit will be assessed in accordance with our cancellation policy.
6. Rental Period
The minimum rental period is 4 days unless otherwise agreed in writing by 2nd LANE.
The Rental Period is inclusive of the first and last day selected. For example, a 4-day rental from Friday to Monday includes both Friday and Monday.
Longer rental periods may be available, subject to Product availability and approval by 2nd LANE. Discounts for extended rentals may apply at our discretion.
7. Product Availability
All bookings are subject to Product availability. Although we take reasonable steps to ensure availability, Products may become unavailable due to late returns, damage, loss, cleaning delays or operational issues.
If a Product becomes unavailable before your Rental Period, 2nd LANE may offer a suitable replacement, store credit, date change or refund for the affected Product.
8. Payments
All Rental Fees, delivery fees, cleaning fees, service fees, bonds and any applicable charges must be paid in accordance with the checkout process.
By placing a booking, you authorise 2nd LANE and/or our third-party payment processor to charge your nominated payment method for:
- the Rental Fee;
- delivery or service fees;
- cleaning fees;
- late fees;
- damage, repair or replacement costs;
- security bonds, where applicable;
- debt recovery, administrative or legal costs where applicable.
You must ensure your payment method remains valid and has sufficient funds. If payment cannot be processed, you remain liable for all outstanding amounts.
9. Security Bond
2nd LANE may require a Security Bond for selected Products, high-value bookings, new customers, interstate bookings or where we consider it reasonably necessary.
If charged, the Security Bond may be used to cover late fees, cleaning fees, damage, loss, replacement costs, missing accessories, administrative costs or any breach of these Terms.
If the Product is returned on time and in acceptable condition, the Security Bond will be refunded after inspection, subject to processing times by banks or payment providers.
10. Delivery and Shipping
2nd LANE offers Australia-wide delivery for eligible bookings. Delivery timeframes are estimates only and may depend on courier or postal services.
You are responsible for providing a correct and complete delivery address. 2nd LANE is not liable for delays, failed deliveries or lost parcels caused by incorrect or incomplete information provided by you.
For interstate bookings, you must allow sufficient time before your rental start date for delivery. We recommend booking with enough time to account for possible courier delays.
11. Returns
You must return the Product on or before the agreed Return Date using an appropriate tracked postage, courier or in-person return method approved by 2nd LANE.
Unless otherwise agreed, return postage is your responsibility.
All Products must be returned:
- on time;
- in the original or suitable protective packaging;
- with tracking details provided to 2nd LANE;
- using express or next-business-day delivery where required;
- with insurance cover equivalent to the RRP where reasonably appropriate.
If a Product is lost, delayed or damaged during return shipping, you remain responsible until the Product is safely received by 2nd LANE.
12. Late Returns
Timely returns are essential because Products may be booked by other customers immediately after your Rental Period.
If a Product is returned late, a daily late fee may apply for each calendar day the Product remains unreturned. The late fee may be calculated by reference to the daily rental value of the Product, lost booking opportunities, administrative costs and other losses reasonably incurred by 2nd LANE.
Late fees may continue until the Product is returned or until the total amount owing reaches the RRP or replacement value of the Product.
Payment of late fees does not waive any breach of these Terms.
13. Non-Returned Items
If a Product is not returned within 20 days of the Return Date, 2nd LANE may treat the Product as unreturned, lost or converted.
In such circumstances, 2nd LANE may charge you:
- all accrued late fees;
- the full RRP or replacement value of the Product;
- administrative fees;
- debt collection fees;
- legal costs and recovery costs where applicable.
2nd LANE reserves the right to refer unpaid amounts to a debt collection agency, commence legal proceedings or report suspected theft, fraud or unlawful retention to the relevant authorities.
14. Cleaning
All Products are professionally cleaned between rentals. A cleaning fee may be included or charged as part of your booking.
You must not wash, dry clean, iron, steam, alter, treat, repair or attempt to clean any Product unless 2nd LANE gives prior written consent.
If a Product is returned with excessive staining, odour, dirt, makeup, fake tan, perfume damage or other contamination beyond ordinary use, additional cleaning or repair fees may apply.
15. Care of Products
You agree to treat all Products with reasonable care and return them in the same condition as received, except for ordinary wear consistent with approved use.
You must not:
- alter, cut, dye, pin, sew or resize any Product;
- attach accessories that may damage the Product;
- use Products in a way that is unsafe, unlawful or inconsistent with their intended purpose;
- lend, sell, transfer or allow another person to use the Product without our consent;
- expose Products to excessive staining, smoke, fake tan, perfume, sharp objects or avoidable damage.
16. Damage, Loss and Replacement
You are responsible for any loss, theft, destruction or damage to a Product while it is in your possession or control.
If a Product is returned damaged, 2nd LANE will assess the damage and may consult a professional dry cleaner, tailor, seamstress, repairer or supplier.
You may be charged for:
- specialist cleaning;
- repairs;
- loss of future rental income;
- replacement parts or accessories;
- full RRP or replacement value if the Product cannot reasonably be restored for future rental.
Where a Product is lost, stolen or damaged beyond repair, you are liable for the full RRP or replacement value, regardless of whether the loss or damage was accidental.
17. Optional Damage Cover
2nd LANE may offer optional Damage Cover for selected Products. Where available, this cover must be purchased before the Product is dispatched or collected.
Damage Cover may assist with minor accidental damage such as small repairable fabric issues, broken zips, minor removable stains or loose buttons, subject to assessment by 2nd LANE.
Damage Cover does not cover:
- loss or theft;
- unreturned Products;
- damage caused by misuse, negligence or reckless conduct;
- fake tan, perfume or chemical damage;
- irreparable damage;
- damage that makes the Product unsuitable for future rental;
- shipping loss or damage;
- any damage not disclosed to 2nd LANE promptly.
Each Product must be covered separately. Damage Cover cannot be added after dispatch, collection or use.
18. Condition Evidence
We recommend that you take clear photos or videos of the Product when received and again before return. This may assist if a condition dispute arises.
If you notice any issue when receiving a Product, you must notify 2nd LANE within 24 hours of delivery or collection.
19. Cancellations by Customer
If you wish to cancel your booking, you must notify 2nd LANE in writing at contact@2ndlaneaus.com.au.
Unless otherwise agreed in writing:
- cancellations made 7 days or more before the rental start date may receive a refund, less an $80 processing fee;
- cancellations made 3 to 7 days before the rental start date may receive a 50% refund;
- cancellations made within 48 hours of the rental start date are non-refundable.
Refunds may take up to 8 business days or longer depending on your bank or payment provider.
20. Cancellations by 2nd LANE
2nd LANE may cancel or modify a booking where a Product becomes unavailable due to damage, late return, loss, inventory error, safety concern, delivery issue, suspected fraud or circumstances beyond our reasonable control.
Where this occurs, we may offer a replacement Product, alternative rental date, store credit or refund for the affected Product.
21. Refunds and Late Delivery
If your Product does not arrive in time for your Rental Period due to an issue within 2nd LANE’s reasonable control, you may be eligible for a refund, store credit or date change.
To qualify for a full refund due to late delivery, the Product must be returned unused within 24 hours of delivery, unless otherwise agreed by 2nd LANE.
If you keep, use or return the Product after the original Rental Period, refund eligibility may be reduced or refused and late fees may apply.
Refunds are not provided for change of mind, incorrect size selection, weather conditions, travel changes, unused rental days, failure to collect, failure to return on time or circumstances outside our reasonable control.
22. Product Fit, Sizing and Condition
2nd LANE provides product descriptions, size information and styling support where possible. However, you are responsible for selecting the correct size and ensuring the Product is suitable for your intended use.
As rental Products may be archive, pre-loved or previously hired pieces, minor signs of wear may be present and are not considered defects.
23. In-Person Try-Ons and Styling Appointments
Private styling and try-on appointments may be available by appointment only. Appointment availability is not guaranteed.
2nd LANE may refuse or cancel appointments due to capacity, availability, customer conduct, safety or operational requirements.
24. Courier and Postal Services
2nd LANE may use or accept delivery through third-party courier and postal providers. These providers operate independently of 2nd LANE.
To the maximum extent permitted by law, 2nd LANE is not liable for delay, loss or damage caused by third-party courier or postal providers, except where required by Australian Consumer Law.
You are responsible for dealing directly with the courier or postal provider for claims relating to return shipping where you arranged the return service.
25. Insurance and Stock Cover
2nd LANE may maintain business insurance or stock cover for Products while they are in our possession. This does not cover Products while they are in your possession, control or return transit unless expressly stated in writing.
Any insurance held by 2nd LANE does not limit your liability under these Terms.
26. Prohibited Conduct
You must not:
- use the website or services for unlawful, fraudulent or commercial purposes without consent;
- provide false or misleading information;
- impersonate another person;
- interfere with the website or its security;
- copy, scrape or misuse website content;
- abuse, threaten, harass or disrespect 2nd LANE staff, contractors or customers;
- retain, sell, alter or dispose of Products belonging to 2nd LANE;
- create multiple accounts to avoid obligations or restrictions.
2nd LANE may suspend, cancel or refuse service where prohibited conduct occurs.
27. Intellectual Property
All website content, branding, text, images, logos, designs, graphics, product photography and other materials are owned or licensed by 2nd LANE and are protected by intellectual property laws.
You must not copy, reproduce, distribute, modify or use our content without written consent.
28. Website Use and Availability
2nd LANE may update, suspend, modify or discontinue any part of the website or services at any time without liability.
We do not guarantee that the website will be uninterrupted, error-free or free from viruses or harmful components.
29. Privacy
Your personal information is collected, used and stored in accordance with our Privacy Policy. By using our services, you consent to our collection and use of your information for booking, payment, delivery, verification, customer service and legal compliance purposes.
30. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law that cannot lawfully be excluded, restricted or modified.
Where liability may be limited by law, our liability is limited, at our option, to the resupply of the services or the cost of having the services supplied again.
31. Limitation of Liability
To the maximum extent permitted by law, 2nd LANE is not liable for indirect, incidental, special or consequential loss, including loss of enjoyment, loss of opportunity, travel disruption, emotional distress, lost profits or reputational damage arising from your use of our website, Products or services.
32. Indemnity
You agree to indemnify 2nd LANE, its owner, employees, contractors and agents against any loss, damage, claim, liability, cost or expense arising from your breach of these Terms, misuse of a Product, unlawful conduct, damage to Products or failure to pay amounts owed.
33. Debt Recovery and Enforcement
If amounts remain unpaid, 2nd LANE may recover the debt by any lawful means, including charging your payment method, issuing invoices, engaging debt collection services, commencing legal proceedings or reporting suspected fraud or theft.
You agree to pay all reasonable administrative, collection, legal and enforcement costs incurred by 2nd LANE in recovering amounts owed.
34. Dispute Resolution
If a dispute arises, you agree to contact 2nd LANE first so we can attempt to resolve the matter in good faith.
If the dispute cannot be resolved informally, the parties may refer the matter to mediation or another appropriate dispute resolution process before commencing legal proceedings, except where urgent relief, debt recovery or enforcement action is required.
35. Governing Law
These Terms are governed by the laws of New South Wales, Australia. The parties submit to the jurisdiction of the courts and tribunals of New South Wales and any applicable federal courts of Australia.
36. Changes to These Terms
2nd LANE may update these Terms from time to time. The updated version will be published on our website with the revised date. Your continued use of the website or services after changes are published constitutes acceptance of the updated Terms.
