By accessing and using the ‘2nd LANE’ website at www.2ndlaneaus.com.au (‘Site’), you accept and consent to the practices in these Terms and Conditions.

KEY TERMS AND DEFINITIONS

1. For the purposes of these Terms and Conditions, the following definitions apply:

“2nd Lane AUS”, “we”, “us”, “our” – Refers to 2nd Lane AUS, ABN 78 76 3103271, the operator of the website and provider of the rental Services.

“Account” – Refers to a registered user profile created on the Site to access and use Services.

“Agreement” – Means these Terms and Conditions, including any linked policies, which together form a binding agreement between the User and 2nd Lane AUS.

“Booking” or “Rental Booking” – A confirmed request made by a User to rent a Product for a specific period.

“Content” – Includes all materials on the Site including text, images, logos, graphics, and intellectual property owned or licensed by 2nd Lane AUS.

“Customer”, “User”, “you”, “your” – Any person who accesses the Site, creates an account, or uses the Services.

“Damage Insurance” – An optional paid service that provides limited coverage for certain types of accidental damage to rented Products.

“Delivery Date” – The date on which the Product is scheduled to arrive at the address provided by the Renter.

“Late Fee” – Charges applied when a rented Product is not returned on or before the agreed Return Date.

“Admin Fee” or “Administrative Fee” – A non-refundable fee that may be charged to cover costs associated with processing, handling, or managing certain aspects of your Booking or Account, including but not limited to cancellations, late returns, failed deliveries, or other special service requests.

“Third-Party Fees” – Any additional charges incurred through services provided by external providers engaged by 2nd Lane AUS, including but not limited to payment gateway fees, identity verification services, delivery or courier charges, debt collection agency fees, and other transaction-related or enforcement costs. These fees may be passed on to the User where applicable.

“Product” or “Item” – Any clothing, accessory, or item made available for rent through the Services.

“Rental Fee” – The amount charged for the use of a Product for a specified rental period.

“Rental Period” – The time frame agreed upon between 2nd Lane and the User during which the Product is in the User’s possession.

“Return Date” – The final date by which the Product must be shipped or returned to 2nd Lane.

“Security Bond” – A refundable deposit, when applicable, collected to cover potential damages or loss.

“Services” – All services provided by 2nd Lane AUS, including clothing and accessory rentals, customer support, delivery, and returns.

“Site” – Refers to our website at www.2ndlaneaus.com.au.

“Contents Insurance / Stock Cover (Specialized)” – A comprehensive insurance policy that covers the value of Products held by 2nd Lane AUS in its inventory. This coverage includes protection against theft, accidental damage, and destruction while the Products are in the possession of 2nd Lane AUS, prior to being rented out to Users. The insurance does not cover the Products once they are in the possession of the User, unless Damage Insurance has been purchased.

“Terms” – This document, which governs the use of the Site and Services.

“Third-Party Providers” – Any external service used by 2nd Lane AUS to support business functions (e.g. payment gateways, courier services, ID verification tools).

TERMS OF SERVICE (ToS)

2. This Terms of Service agreement (“Terms”) is between you (“you” or “your”) and 2nd LANE (“we,” “our,” “us,” or “2nd LANE AUS”) and governs your access to and use of our website located at www.2ndlaneaus.com.au (the “Site”), and related services, including Rent the 2nd LANE AUS’s product rental services (together with the Site, and the Content (as defined below), the “Services”). These Terms also apply to in-person rentals, part of the Services. 

3. Please review these Terms carefully; by accessing or using any of the Services, including creating an Account (as defined below), you acknowledge that you have read, understood, and agreed to be bound by these Terms. 

4. These Terms are a legally binding contract between you and Rent the 2nd LANE. By accepting these Terms, you represent that you are an individual of legal age to form a binding contract or, if you are not, that you have obtained parental or guardian consent to enter into these Terms. Under no circumstances may you access or use the Services if you are under thirteen (13) years old. Your access to and use of the Services in any way also means that you agree to all of these Terms, which will remain in effect while you access or use the Services. These Terms incorporate by reference any additional terms and conditions posted by 2nd LANE through the Site or otherwise made available to you by 2nd LANE (the “Additional Terms”), and you understand and agree that by accessing or using our Services, you agree to also comply with all Additional Terms.

5. If you do not agree to these Terms, you have no right to obtain information from or otherwise continue using the Site or Services. Failure to use the Services in accordance with these Terms may subject you to civil and criminal penalties.

Arbitration Agreement

6. We aim to resolve disputes amicably. If necessary, disputes may be referred to a mediator or arbitrator under Australian law. Nothing in this clause affects your right to take a matter to a tribunal or court.

7. By agreeing to these Terms and Conditions, you acknowledge and agree that any disputes or claims arising between you and 2nd LANE will be resolved through binding individual arbitration, as per applicable laws. You waive any right to participate in a class action lawsuit or class-wide arbitration, as well as your right to a trial by jury.

8. If any amounts owed remain unpaid after the agreed rental period, 2nd LANE reserves the right to employ third-party debt collection services to recover the outstanding balance, and you agree to bear the cost of any collection fees. In cases of fraud or criminal conduct, 2nd LANE may file a police report and pursue any legal action deemed necessary, including but not limited to court proceedings for recovery of the outstanding debt.

Compliance with Australian Consumer Law

9. We are committed to ensuring all charges, including late fees and replacement costs, are fair, reasonable, and compliant with the Australian Consumer Law (ACL).

Late Fees

10. Our late fee structure is designed to reflect a genuine estimate of the loss incurred when an item is not returned on time. If you are charged the full retail value of a non-returned item, it becomes your property, and no further fees will apply. If you believe a fee is unfair or incorrect, please contact us to resolve the matter promptly.

11. All users must comply with a standardised Late Fee Policy enforced by 2nd LANE to protect the integrity of the service and ensure fairness to all clients. 2nd LANE relies on the timely return of rented items to maintain service quality and inventory availability. In the event that an item is not returned by the agreed return date, the renter will incur a late fee equivalent to the daily rental charge for each calendar day the item remains unreturned.

12. Late fees will be capped at either four (4) weeks of rental charges or the Recommended Retail Price (RRP) of the item, whichever is greater, unless otherwise determined by 2nd LANE at its sole discretion. The renter agrees to these terms upon submitting any booking request on the platform.

13. 2nd LANE reserves the right to charge the payment method on file in the renter’s account, or otherwise recover payment by any legal means available, where it determines, in its sole discretion, that an item has been returned late. If 2nd LANE is unable to collect the outstanding fees via the stored payment method or other means, the renter agrees to remit payment upon request.

14. In cases of non-payment, the outstanding amount may be referred to a debt collection agency, and the renter shall be liable for all associated recovery and legal costs.

Modifications

15. At any time and without liability, we may suspend, modify, or discontinue all or part of the Services (including access to the Site via any third-party links). We encourage you to check our Site periodically for the most current Service offerings. Similarly, we may update the Content, including descriptions and specifications about Products or Services. We reserve the right to remove any Content (as described below) at any time, for any reason (including, but not limited to, if someone alleges you contributed Content in violation of these Terms), in our sole discretion, and without notice. 2nd LANE will have no liability for any change in the Services or suspension or termination of your access to the Services.

16. We also reserve the right to change these Terms at any time by notifying you of such changes by any reasonable means, including by posting the revised Terms on the Site. The “Last Updated” legend above indicates when these Terms were last changed. At our discretion, we may also notify you of specific changes by emailing the email address associated with your Account. You are responsible for providing us with your current email address when you create an account and, if your email address changes, updating your account information to reflect your new email address. Your continued use of the Services, including by renting or purchasing Products (as defined below) from us, following any changes to these Terms will indicate your acknowledgment of such changes and agreement to be bound by the revised Terms. Any changes to the Terms will not apply to any dispute between you and us that arises before the date we posted the revised Terms incorporating such changes or otherwise notified you of such changes. If you disagree with the new Terms, you may no longer access or use the Services. 

How the Site and Services Work

Rental and Financial Terms

17. The Site and Services are designed to facilitate the listing and rental of luxury fashion items (“Products”). These Products are made available for rent through Listings on the Site and Services by 2nd Lane AUS. You may browse Listings as an unregistered visitor; however, to make a Rental Booking or access certain features, you must first create an Account with 2nd Lane AUS.

Account Registration

17. As noted above, you will need to be 13 or older to access or use the Services. To use the Services, you may be required to sign up for an account (your “Account”), select a password and username (your “2nd LANE ID”), and provide us with certain information or data, such as your contact information. You promise to provide us with accurate, complete, and up-to-date information and to maintain and update such information. You may not select as your 2nd LANE User ID a name that you don’t have the right to use or another person’s name with the intent to impersonate that person. We may reject the 2nd LANE User ID and password if you change any other information you provide to us when registering for an Account. You may not transfer your Account to anyone else without our written permission. You may only register one Account per Paid Service (as defined below).

18. You may only use the Services and Products made available to you for your own personal, non-commercial use, and not for or for the benefit of any third party, and only in a manner that meets all laws that apply to you. If your use of the Services or Products is prohibited by these Terms or any Additional Terms or applicable laws, then you are not authorized to use the Services or Products. You are solely responsible for any use by you of any Services or Products in violation of these Terms, any Additional Terms, or applicable law.

19. You may not share your Account (including your 2nd LANE User ID or password) with anyone, and you must protect the security of your Account (including your 2nd LANE User ID and password) and any other access tools or credentials. You’re solely responsible for any activity associated with your Account, including all charges incurred from using the Services with your Account.

20. For any reason, we may limit or restrict your access to or use of the Services, including, but not limited to, refusing to fulfill any order you place with us or restricting orders placed under a single customer account, payment card, or billing or shipping address. We reserve the right to limit, cancel, or prohibit any use of the Services for any reason in our sole discretion, including but not limited to availability and geographic concerns, or if we determine or suspect that you are using the Services for fraudulent or commercial purposes or any other purposes in violation of these Terms or any Additional Terms.

21. We may charge you to access and use certain parts of the Services (the “Paid Services”). We reserve the right to modify or waive fees required to use certain parts of the Services. You are solely responsible for (i) the fee for any Paid Services that you order and that are not canceled by our cancellation policy, (ii) the price of any Products that are not returned by our policies, and (iii) any late fees accrued by you due to late or lost items. Please note that any pricing, fees, and payment terms presented to you when using or signing up for a Paid Service are deemed part of these Terms.

22. If you rent a Product through our Reserve Service, the rental fee (“Rental Fee”) will include only the rental coverage charges listed on the Reserve Service for your rental of the relevant Product, and you authorize us (or our third-party payment processor) to charge your Payment Method (as defined below) the Rental Fee. 2nd LANE reserves the right to alter the Rental Fee or availability of any particular item at its discretion and without notice. 

Courier Services

No Responsibility for Courier Services

23. 2nd Lane AUS does not provide or recommend any specific courier services, nor do we offer door-to-door delivery options through third-party providers. As such, the responsibility for shipping, delivery, and the associated risk of loss or damage is from the client.

Exclusion of Liability

24. 2nd Lane AUS is not involved in any courier, postal, or shipment services related to the rental or return of Products. We disclaim all liability for any loss, damage, delays, or other issues that may arise from the use of third-party courier services.

User Responsibility

25. It is the User’s responsibility to choose reliable shipping methods and to ensure the timely and secure return of rented Products. Any disputes or claims related to the delivery or return of items via courier must be addressed directly between the User and the third-party service provider.

Rental and Financial Terms 

26. 2nd Lane AUS is solely responsible for fulfilling confirmed rental bookings and ensuring the availability of the rented Products through our Site and Services. By proceeding with a rental, you, as the Borrower, agree to accept and comply with all terms, conditions, and any rules associated with the use of the rented Product.

27. The rental agreement is made directly between you and 2nd Lane AUS. All obligations, including care, return, and adherence to the rental period, are set and enforced by 2nd Lane AUS. We are responsible for the provision and delivery of your selected item(s).

28. Your payment to 2nd Lane AUS covers the total Rental Fee, which includes the product rental cost, any applicable taxes, insurance (if selected), and relevant service or courier fees. Once payment is made, your financial obligation is considered fulfilled, and 2nd Lane AUS will manage all associated payments to third-party service providers on your behalf.

29. 2nd Lane AUS acts as the sole payment processor for all rentals. Any disputes or additional charges outside of the agreed Terms will be handled directly by 2nd Lane AUS. We are not responsible for any issues or losses related to third-party courier services unless otherwise stated.

30. In cases where discrepancies arise regarding payments or services, any claims must be directed to 2nd Lane AUS. You will not be held liable for payment fulfillment beyond the initial transaction completed through our platform.

Payments and Service Fees

31. In connection with your rental through 2nd Lane AUS, you will be required to provide standard billing information such as your full name, billing address, and credit card or payment method details. This information will be collected either directly by 2nd Lane AUS or securely via a third-party payment processor.

32. By proceeding with your booking, you authorize 2nd Lane AUS to charge your chosen payment method for the total amount of the confirmed rental, in accordance with our Terms and Conditions. Accepted payment methods include major credit/debit cards, PayPal, and other options listed on our Site.

33. You also authorize 2nd Lane AUS to charge your card for any additional fees that may arise, including but not limited to:

Charges related to damages, loss, or alterations beyond normal wear and tear (as outlined under Damage & Returns).

Late return fees

34. Non-return or failure to comply with return procedures.

35. Security bond charges (if applicable and not already held).

36. If payment is processed via a third-party provider, such as Stripe or PayPal, you may be subject to that provider’s terms and privacy policy. We recommend reviewing their terms before proceeding with payment.

37. Once your rental is confirmed and payment is successfully processed, you will receive a confirmation email with a full summary of your booking details, including item(s), rental period, fees paid, and return instructions.

38. Service fees are included in the total rental amount and cover administrative, operational, and platform-related costs associated with processing and fulfilling your order.

Security

Mandatory checking identity 

39. At 2nd LANE, trust and safety are at the core of everything we do. As a platform dedicated to luxury fashion rentals, we require identity verification to ensure a secure and seamless experience for both our renters and our team.

Agreement at Checkout

40. All rentals are legally binding contracts. When you proceed to checkout and tick the box agreeing to our Terms & Conditions, you are entering into a firm agreement with 2nd LANE.

What Happens Next

41. Once your booking is confirmed:

42. You will receive a rental agreement and an invoice.

43. To finalise the transaction, we require you to complete your profile with your full name, delivery address, and contact number.

44. You must sign and return the rental agreement along with a copy of valid photo ID confirming your address (e.g., driver’s license or passport with proof of address).

45. 2nd LANE uses secure third-party systems to verify identity and protect all parties involved. This step ensures we uphold the trust, safety, and integrity of our luxury rental experience.

46. After your booking, you will receive your contract and invoice, and we will request that you complete your personal information, such as address and phone number, in your 2nd LANE account. This is a crucial step to finalize your booking, as you accepted our Terms and Agreements when you finalized your booking.

47. You agree to treat the Products with great care. The rental coverage we provide covers normal wear and tear. Still, you are responsible for any loss, destruction, or damage to the Products for any reason, including theft, loss, mysterious disappearance, fire, major stains, or any other cause. “Normal wear and tear” means minor stains, rips, missing beads, stuck zippers, or other minor damage covered by the rental coverage. Suppose you return a Product that is damaged beyond normal wear and tear. In that case, you hereby authorize us (or our third-party payment processor) to charge your Payment Method for repairing or replacing the Product, as determined in our discretion, up to the Original Retail or Comparable Value price for the Product.

Security Bond (When is the business interested analizing client's profile) 

48. To ensure the preservation of our dress collection and provide a worry-free experience, we can require a security bond for each piece. The security bond acts as a refundable deposit and covers any significant damage, loss, or alterations beyond normal wear and tear.

49. Upon booking, a security bond can be charged to your card. The amount will be communicated and is subject to our discretion based on the piece's value.

50. If charged, the security bond will be refunded promptly upon the piece's return in its original condition and on time, provided there are no damages or breaches of our terms and conditions.

51. In the event of significant damage, loss, or alterations beyond normal wear and tear, the security bond will cover the necessary repairs, replacement, or associated costs. You will be responsible for the remaining amount if these expenses exceed the bond. If the bond wasn't charged at the booking, we have the right to take the money out of your card.

52. Please note that the security bond and insurance are necessary to protect the quality and integrity of our collection. When proceeding with a rental, you agree to adhere to our terms and conditions.

53. Our team will assess any damages or breaches of our terms and conditions, and we will strive for fairness and transparency throughout the process. We may contact you to discuss the situation and resolve any issues.

54. By complying with our terms and conditions, you contribute to the sustainability of our business and help us maintain our exceptional dress hire services.

55. Our team is available to address any questions or concerns you may have regarding the security bond, insurance, or any other aspect of our dress rental services. Please reach out to our customer support team for assistance.

56. We reserve the right to update or modify our security bond and insurance terms and conditions at any time. You are responsible for reviewing and understanding the most recent version before proceeding with a dress rental.

Contents Insurance / Stock Cover (Specialized) Terms Clause

Coverage Scope
57. 2nd Lane AUS maintains a Contents Insurance / Stock Cover policy to ensure the safety and protection of the fashion items in our inventory. This specialized coverage includes:

- Protection against theft, burglary, and break-ins at our premises.

- Accidental damage to Products while in storage or being processed.

- Damage due to natural disasters (fire, flooding, etc.) before items are rented out.

Exclusions
58. The Contents Insurance / Stock Cover policy does not cover:

- Items once they have been rented out to a User.

- Loss or damage that occurs during transit between 2nd Lane AUS and the User.

- Any negligence, improper handling, or misuse that results in damage while a Product is in a User’s possession (this is covered under the Damage Insurance policy, if purchased).

Stock Valuation
59. The value of the Products in our inventory is regularly assessed to reflect the retail value of each item. In the event of total loss or irreparable damage, 2nd Lane AUS reserves the right to assess the replacement or repair cost and seek compensation accordingly.

Notification of Loss/Damage
60. In the event of damage or loss prior to rental, Users may be informed of a delay or non-availability of specific Products due to claims under the Contents Insurance policy. 2nd Lane AUS will offer alternative Product options in these situations.

Third-Party Claims
61. Any third-party claims (e.g. for damages caused by a third-party service such as courier delivery) will be handled separately from the Contents Insurance policy. If relevant, Users may be required to liaise with the third-party provider for claim resolution.

Rental Period 

62. Rental periods start at a minimum of 4 days and can be as long as you and 2nd LANE agree. Please note that you will need to receive and return within a short period for short rentals, so please consider this when booking rentals.

63. The rental period you have selected for your rental is 'inclusive'. For example, a 4-day rental period can mean that your item will arrive by Friday and you will post it back on Monday. In this example, both Friday and Monday are included in the 4-day period.

64. Rental periods start at a minimum of 4 days and can be as long as you and 2nd LANE agree. Please note that you will need to receive and return within a short period for short rentals, so please consider this when booking rentals.

65. We automatically apply a discount to bookings lasting more than 8 days. If you have longer travel plans, please contact us, and further discounts will be applied.

Delivery and returns

66. For residents of Sydney, you must book at least 24 hours before your first rent date. For interstate residents, you must ensure the items you are booking are available for at least three days before your first date of rent. When we process your booking, we must block the dates necessary for delivery to your address. Express Shipping can take 1 to 2 business days.

Sydney-based Pick up and drop off

67. If you choose the pick-up option, you will be emailed with the address and time that your order will be ready to pick up and drop off when your rental period finishes. The times must be respected; otherwise, you will be charged proportionally for your late delivery.

NSW Express Shipping Delivery

68. If you choose the delivery option, and we are based in Sydney, you will receive the item one day before the first day of rental. 

Interstate Express Shipping Delivery 

69. For interstate residents, you must ensure the items you book are available at least three days before your first rent date. When we process your booking, we must block the dates necessary for delivery to your address. Express Shipping can take 1 to 2 business days. Please contact us if this rule doesn't apply, and we will help you find the best delivery option on the date you need.

70. You must expressly ship us back your order on the last day of your booking using the same package we sent you. 

71. If your item doesn't arrive on the first day of your rental, you should contact 2nd LANE immediately. 

72. As a renter, you are entitled to a full refund if your item does not arrive on time. However, to receive a full refund, the renter must return the item within 24 hours of delivery. A partial refund might be more appropriate if an item is returned later than this. If the item is kept longer than the number of days of the original rental, the 2nd LANE can charge you late fees.

73. If an item is delivered late and the renter keeps it for longer than the rental period, they are liable for paying late fees to the 2nd LANE and will not be eligible for a refund. Please feel free to request a refund or organize to change your rental dates by contacting us.

Late Fees and Non-Returned Items

74. If a rented item is not returned by the agreed Return Date, a daily late fee will apply. This late fee will continue to accrue until one of the following occurs:

75. The item is returned to 2nd Lane AUS, or:

- The total accumulated late fees reach the item’s full retail value (referred to as the Maximum Late Fee).

- Once the Maximum Late Fee has been reached and paid in full, ownership of the item transfers to you. At that point, the item is considered purchased and is provided “as is”, with no warranties, refunds, or exchange options.

76. Please note that late fees are in addition to:

- The original rental fee

- Any packaging or shipping costs

- Cleaning or damage-related charges

- Administrative or processing fees

- Charges incurred via third-party debt collectors (if applicable)

77. Failure to return an item on time is considered a breach of the rental agreement. Payment of late fees does not nullify this breach, and 2nd Lane AUS reserves the right to pursue further action if necessary, including the involvement of third-party collection agencies to recover outstanding balances.

Paying for Your Rental

78. When you place a rental booking with 2nd Lane AUS, your payment method will be authorized to ensure sufficient funds are available. This amount is held while your booking is being reviewed.

79. If your rental is accepted, the payment will be processed and made to 2nd Lane AUS.

80. If your rental is declined or expires (after 24 hours), the authorization will be released, and your funds will return to your account. Depending on your bank, this may take up to 8 business days.

81. If your rental is cancelled, the transaction may be reversed automatically. In such cases, the original authorization may disappear from your statement entirely, and no charge or refund will appear — it will look as if the transaction never occurred.

Delivery Policy

2nd Lane AUS charges a flat rate of $25 for one-way express delivery, which will be added to your booking at checkout.

Return delivery is your responsibility and must be sent via express post in the original packaging on the final day of your rental period.

Return Delivery & Packaging Guidelines

Returning Your Rental

You have two options for returning your rental:

In-person return

Express postage/delivery return (one-way postage covered)

Postage Returns

All items must be returned on the last day of the rental with next-day delivery.

You are responsible for paying for postage and making sure the item is sent tracked and insured for its full retail value (RRP).

If the item is lost or damaged during shipping, you will be responsible for compensating 2nd LANE. However, if insured, you can claim this back from your courier.

Please send us tracking details and proof of postage as soon as the item is sent.

Late Returns

If your rental is returned late, or sent with incorrect postage or an incorrect address, a late fee will apply as per our terms and conditions.

All rentals must be packaged and shipped back to 2nd Lane AUS on the final day of your rental period using suitable packaging that protects the garment during transit.

Return Delivery – Postage Type

You may choose your preferred postal or courier service for returns; however, we strongly recommend the following:

Use Express Shipping with next-business-day delivery

Ensure the service includes full tracking

Add insurance cover equivalent to the full retail value (RRP) of the item

If your return is not shipped with the appropriate insurance cover and the item is lost or damaged in transit, you will be held liable for the full RRP of the garment.

International postage is not permitted.
2nd Lane AUS only services rentals within Australia. We do not allow shipping to or from international addresses under any circumstances.

Sundays & Public Holidays – Return Policy

Please keep in mind that postal services don’t usually run on Sundays or public holidays.

If your rental ends on a Sunday or public holiday, and your courier doesn’t ship that day, you must contact 2nd LANEto let us know when you’ll send the item back.

You’ll need to use next-business-day express postage to return it quickly.

If this isn’t possible, you may be asked to extend your rental to cover the extra day.

2nd LANE is not responsible for delays, lost items, or issues with postage providers.
But we’re happy to help you contact your courier if needed.

Returning your Rental

Depending on the agreement you have with 2nd LANE, you can make your return in two ways:

In-person return;

Express Postage/Delivered returns (one-way payment coverage).

Damage & Altering Your Rental

You must return the item in the exact same condition as when you received it. No alterations are allowed, including but not limited to:

Pinning

Adding accessories

Dying

Cutting or altering the size

We highly recommend purchasing insurance for your rental to cover any accidental damage. If you and 2nd LANE agree to any adjustments, this can be discussed beforehand.

Cleaning Your Rental

All rentals from 2nd LANE (including apparel and boots) are subject to a 10% cleaning fee based on the booking price. This fee covers the professional cleaning of our items, as all our pieces are made from special fabrics and are taken to professional laundries for cleaning.

Do not attempt to clean, alter, iron, or press any items unless agreed upon with us beforehand.

All items are steamed before dispatch, but light creasing during transit is normal and not considered damage.

If an item is returned with excessive dirt, stains, or damage beyond normal wear, additional cleaning or repair fees will apply. These fees will be charged to your original payment method.

What if I accidentally stain or damage a rented item?

Please get in touch with 2nd LANE at [email protected]. When the item is received back, we'll carry out a condition report, assess the damage, and consider a suitable solution, whether laundering, repair, or an additional charge, in part or whole, from the renter as compensation to 2nd LANE for their loss.

Proof of condition

We would always recommend that you have proof of the condition of your rental.

This is good to have in case anything happens during the rental and a dispute arises. Without proof of condition, 2nd LANE cannot analyze any damage dispute.

What photos should I take?

As a renter, photos should be taken when you receive and return your rental.

Include photos of any pre-existing damage (if applicable) and show the item's general condition.

When you receive the rental

Take pictures of the day you received the item. Make sure to notify us of any undisclosed damage.

Before you return the rental

Please take pictures of the day you returned your item and notify us immediately if you accidentally damaged it during your rental.

Damaged/Soiled/Replacement Garment

At 2nd LANE AUS, we offer Contents Insurance / Stock Cover (Specialised), which is optional for clients to purchase. This specialised coverage protects our rental garments against:

Theft

Accidental damage

Fire or water damage

This coverage is available for rental stock only and is not mandatory. Clients have the option to purchase this insurance for added peace of mind.

Insurance Fee Structure

The insurance fee is 5%–10% of the RRP (Recommended Retail Price) of the item, depending on its value.

Example: For a $2,000 FUSALP ski suit, the insurance fee would be $100–$200.

This insurance helps cover:

Accidental damage

Cleaning

Minor wear and tear

Contribution to loss cover

Damage Liability

If a garment is returned damaged and you did not purchase insurance, you will be responsible for the full RRP(Recommended Retail Price) of the item’s replacement.

Insurance coverage applies for common accidental damage, such as:

Broken zips

Minor fabric splits

Small holes

Broken straps

Loose/lost buttons/jewels

Removable stains

This insurance is available at the time of booking, and it must be purchased for each individual piece. Insurance cannot be added after the garment has been dispatched or collected.

Important Notes:

Insurance does not cover damage that makes a garment unfit for future rentals. If the garment is beyond repair, you will be charged the full RRP for replacement.

You are responsible for the cost of repairs or replacement if you choose not to purchase insurance and the item is returned damaged.

Each item must be insured separately. If insurance is not selected for each piece, only the first piece will be covered under insurance.

Missed Hire Bookings Due to Damage/Repair Delays

At 2nd LANE, we understand that accidents can happen, and we want you to enjoy your event without worrying about minor or unexpected damage to your garment. If any damage occurs during your rental, please follow these steps:

Contact 2nd LANE immediately and inform us about the damage.

Take photos of the damage and provide a brief description.

Advise whether you have purchased insurance cover for your hire.

Even if damage occurs, the garment must still be returned by the agreed rental return date. Once the item is returned, we will assess the damage and apply for insurance coverage, if applicable. Should the garment be beyond repair, we will calculate any further charges per our terms and conditions.

All decisions on whether the garment can be repaired and re-hired will be made in consultation with a seamstress or dry cleaner as necessary. 2nd LANE's decision is final and binding on the client.

Replacement for Lost, Stolen, or Irreparably Damaged Items

If the garment is lost, stolen, or damaged beyond repair, whether or not such loss, theft, or damage is attributable to negligence, failure, or omission on the part of the user, the User will be liable for the replacement cost of the item, which will be the full Recommended Retail Price (RRP).

Caution with Fake Tan and Perfume

2nd LANE advises the user to be extremely cautious when using fake tanning products or perfume. If the garment is stained with fake tan or if the perfume damages the fabric, rendering the item unable to be re-hired, 2nd LANE reserves the right to charge the User the full replacement value of the item, subject to our assessment of the replacement value.

Unreturned Items and Enforcement After 20 Days

If a rented item is not received by 2nd LANE within 20 days from the original return due date, this will be considered a material breach of this agreement. In such cases, 2nd LANE reserves the right to:

Charge a daily late fee, equivalent to the original rental rate per day, for each day the item remains unreturned, up to a maximum of 30 days.

Charge the full retail value (RRP) of the unreturned item, as listed at the time of booking.

If the payment method on file is invalid or cancelled, this will be treated as a breach of contract. In this case, 2nd LANE may engage third-party debt collection services to recover the outstanding amount, and the client will be responsible for all related collection and legal costs.

These charges will be automatically applied to the payment method on file. If payment cannot be processed, 2nd LANE will use debt collection services to recover the payment immediately.

Billing and Payments

How Payments Work

When you place a rental order for a Product, you authorize 2nd LANE to charge your payment card or other payment instrument (“Payment Method”) for the Rental Fee. You must ensure that, at all times, your Payment Method is valid and up-to-date. You are responsible for providing complete and accurate billing and contact information to 2nd LANE and notifying 2nd LANE of any changes to such information. 2nd LANE will charge your Payment Method the amount of the Rental Fee immediately upon your rental order. A reservation of a Product through the Services is an order for the rental of that Product, regardless of how far in advance that Product is reserved. In addition, at the time of your rental order for a Product, you at this moment authorize 2nd LANE to charge your Payment Method for an amount up to the Original Retail or Comparable Value price of the Product set forth on the applicable Service plus applicable sales taxes; provided that 2nd LANE will only charge your Payment Method for an amount that is greater than the Rental Fee as described in these Terms. Rental Fees exclude all federal, state, and local taxes, goods and service tax, fees, customs, duties, levies, and other governmental assessments, all of which shall be paid by you directly or, if paid by 2nd LANE, shall be paid by you to 2nd LANE in connection with your rental order. 

We use a third-party payment processor (the “Payment Processor”) to bill you for any Paid Services through a payment account linked to your account (your “Billing Account”). By choosing to use Paid Services, you agree to pay us, through the Payment Processor, all charges at the prices then in effect for any use of such Paid Services by the applicable payment terms, and you authorize us, through the Payment Processor, to charge your chosen Payment Method. You agree to make payment using that selected Payment Method. Still, if the Payment Processor cannot charge your preferred Payment Method, you authorize us to use any Payment Method stored on record for your Billing Account. We reserve the right to suspend or cancel a rental order or terminate your access to the Services if we cannot successfully charge the provided Payment Method. We are not responsible for errors by the Payment Processor, and we reserve the right to correct any errors or mistakes that we or the Payment Processor make(s) even if we have or our Payment Processor has already requested or received payment. If we, through the Payment Processor, do not receive payment from you, you agree to pay all amounts due to your billing account upon demand. 

Cancellation Policy

We understand that plans can change, and we strive to be as flexible as possible. Below are the terms for cancellations, including both client-initiated cancellations and cancellations initiated by 2nd LANE due to various factors.

Client-Initiated Cancellations

If you wish to cancel your booking, please notify us as soon as possible. The following terms apply:

Cancellations made 7 days or more before the hire date:
You may cancel your order with a full refund, minus $80 processing fee.

Cancellations made within 3-7 days of the hire date:
You will be entitled to a 50% refund of the total amount paid.

Cancellations made within 48 hours of the hire date:
Unfortunately, we are unable to provide any refund for cancellations made within this period, as the items are being prepared for delivery.

All cancellations must be submitted in writing via email to [email protected]. Refunds will be processed in accordance with our refund policy and may take 8 business days to appear in your account.

Company-Initiated Cancellations

In the unlikely event that we must cancel or modify your booking due to unforeseen circumstances, we will notify you immediately. The following applies:

Damage to Rented Items

If any of the items you have booked are damaged between the time of booking and the scheduled pickup date, and we are unable to replace or repair the item in time for your rental period, we will notify you as soon as possible. In such cases:

If the item cannot be replaced, we will issue a full refund for the affected item(s).

Inventory Issues

In rare cases, if there is an inventory problem (e.g., items become unavailable due to unforeseen circumstances), we will notify you as soon as possible. We will do our best to offer suitable alternatives. If no alternatives are available, we will cancel the order and issue a full refund.

Delivery and Timing Issues

If we are unable to deliver your items on the scheduled date due to operational challenges or delivery issues, we will notify you immediately. We will work to reschedule the delivery at the earliest possible time, or if rescheduling is not possible, we will offer you a refund for the full order or the affected items.

Additional Terms

Replacement and Refund: If we are unable to fulfill your entire order or part of it due to reasons beyond our control (damage, inventory issues, delivery problems), we will make every effort to offer replacements, alternatives, or refunds. We strive to ensure minimal disruption to your experience and will communicate any issues promptly.

Cancellation Window: Any cancellations or changes must be made as early as possible to ensure a smooth experience. For client-initiated cancellations, refunds will be processed based on the timing of the cancellation.

Policy Changes: The cancellation policy is subject to change. Any updates to this policy will be communicated to you before your booking is confirmed.

Information Provided by Customers

You must provide current, complete, and accurate information for your Billing Account. You must promptly update all information to keep your Billing Account current, complete, and accurate (such as a change in billing address, credit card number, or credit card expiration date). If your Payment Method is canceled for any reason (e.g., for loss or theft) or if you become aware of a potential breach of security, such as the unauthorized disclosure or use of your User ID or password, you must promptly notify us and update your Payment Method. Changes to such information can be made in your account settings. SUPPOSE YOU FAIL TO PROVIDE ANY REQUIRED INFORMATION OR KEEP SUCH INFORMATION UP-TO-DATE. IN THAT CASE, YOU AGREE AND ACKNOWLEDGE THAT WE MAY CONTINUE CHARGING YOU USING ANY PAYMENT METHOD YOU HAVE ON RECORD FOR ANY USE OF PAID SERVICES UNDER YOUR BILLING ACCOUNT UNLESS YOU HAVE CANCELLED OR PAUSED YOUR PAID SERVICES OR TERMINATED YOUR ACCOUNT BY THESE TERMS. 

USER CONDUCT

The laws of Australia govern our User Conduct.

By accessing and using the 2nd LANE website at www.2ndlane.com (“Site”), you accept and agree to the practices outlined in this User Conduct policy.

Prohibited Conduct

By using the 2nd Lane AUS website and services, you agree not to:

Contact clients for non-rental purposes: Only reach out to clients regarding their rental or inquiries about the Site. Don’t contact them for anything else.

Solicit clients for competing services: Don’t recruit or encourage clients to join third-party services that compete with 2nd Lane AUS without our written consent.

Impersonate anyone: Don’t pretend to be someone else or misrepresent your relationship with any person or entity while using the Site.

Share personal information without consent: Don’t post or share personal details (like contact info or photos) of others unless you have their permission.

Send spam: Don’t use the Site to send unsolicited commercial emails or ads unrelated to renting items.

Harass or harm others: Don’t stalk, harass, or harm other users. Only collect the personal info needed for your rental transactions.

Offer items you don’t own or have permission to rent: Only list items you own or have the right to rent out on 2nd Lane AUS.

Break the law: Don’t violate any laws, including tax regulations, while using the Site or Services.

Scrape or spider the Site for data: Don’t use automated tools to collect data from the Site unless we give permission.

Access information for unauthorized purposes: Don’t copy, store, or use Site data for anything other than what’s allowed by these Terms.

Infringe on intellectual property rights: Don’t violate anyone’s intellectual property or privacy rights while using the Site or Services.

Use abusive or discriminatory language: Don’t use offensive language or be disrespectful to users or staff, whether in person or online.

Post harmful content: Don’t share fraudulent, false, discriminatory, or harmful content, or anything that promotes violence or illegal activities.

Compile databases without permission: Don’t collect or scrape data from the Site to create a directory or database unless we specifically allow it.

Create multiple accounts: Don’t register more than one account on 2nd Lane AUS, and don’t create accounts on behalf of others without their consent.

Request or rent items you don’t intend to use: Only rent items you genuinely intend to use yourself.

Mislead with pricing or listings: Don’t provide false pricing info or submit rental listings you don’t actually intend to honor.

Monitoring and Disclosures

2nd LANE may access, preserve, and disclose your information if required by law or if it believes it is necessary to:

Respond to legal claims or comply with legal processes (e.g., subpoenas).

Enforce or administer our agreements with users.

Protect the rights, property, or safety of 2nd LANE, its users, or the public.

Suspension or Termination of Account

Arbitration Agreement

We aim to resolve disputes amicably. If necessary, disputes may be referred to a mediator or arbitrator under Australian law. Nothing in this clause affects your right to take a matter to a tribunal or court.

By agreeing to these Terms and Conditions, you acknowledge and agree that any disputes or claims arising between you and 2nd LANE will be resolved through binding individual arbitration, as per applicable laws. You waive any right to participate in a class action lawsuit or class-wide arbitration, as well as your right to a trial by jury.

If any amounts owed remain unpaid after the agreed rental period, 2nd LANE reserves the right to employ third-party debt collection services to recover the outstanding balance, and you agree to bear the cost of any collection fees. In cases of fraud or criminal conduct, 2nd LANE may file a police report and pursue any legal action deemed necessary, including but not limited to court proceedings for recovery of the outstanding debt.

Compliance with Australian Consumer Law

We are committed to ensuring all charges, including late fees and replacement costs, are fair, reasonable, and compliant with the Australian Consumer Law (ACL). Our late fee structure is designed to reflect a genuine estimate of the loss incurred when an item is not returned on time. If you are charged the full retail value of a non-returned item, it becomes your property, and no further fees will apply.
