ABOUT THESE TERMS 

Accepting these Terms

Welcome to 2nd Lane (ABN 78763103271). This Terms of Service agreement (“Terms”) is between you (“you” or “your”) and 2nd Lane (“we,” “our,” “us,” or “2nd Lane AUS”) and governs your access to and use of our website located at www.2ndlaneaus.com.au (the “Site”), and related services, including Rent the 2nd Lane AUS’s product rental services (together with the Site, and the Content (as defined below), the “Services”). These Terms also apply to in-person rentals, part of the Services. 

Please review these Terms carefully; by accessing or using any of the Services, including creating an Account (as defined below), you acknowledge that you have read, understood, and agreed to be bound by these Terms. 

These Terms are a legally binding contract between you and Rent the 2nd Lane. By accepting these Terms, you represent that you are  an individual of legal age to form a binding contract or, if you are not, that you have obtained parental or guardian consent to enter into these Terms. Under no circumstances may you access or use the Services if you are under thirteen (13) years old. Your access to and use of the Services in any way also means that you agree to all of these Terms, which will remain in effect while you access or use the Services. These Terms incorporate by reference any additional terms and conditions posted by 2nd Lane through the Site or otherwise made available to you by 2nd Lane (the “Additional Terms”), and you understand and agree that by accessing or using our Services, you agree to also comply with all Additional Terms.

EXCEPT FOR LIMITED CIRCUMSTANCES DESCRIBED IN SUBCLAUSE (c) OF THE ARBITRATION AGREEMENT BELOW, YOU AGREE THAT DISPUTES BETWEEN YOU AND US WILL BE RESOLVED BY BINDING, INDIVIDUAL ARBITRATION AND YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION, OR TO A TRIAL BY JURY.

Changes

At any time and without liability, we may suspend, modify, or discontinue all or part of the Services (including access to the Site via any third-party links). We encourage you to check our Site periodically for the most current Service offerings. Similarly, we may update the Content, including descriptions and specifications about Products or Services. We reserve the right to remove any Content (as described below) at any time, for any reason (including, but not limited to, if someone alleges you contributed Content in violation of these Terms), in our sole discretion, and without notice. 2nd Lane will have no liability for any change in the Services or suspension or termination of your access to Services.

We also reserve the right to change these Terms at any time by notifying you of such changes by any reasonable means, including by posting the revised Terms on the Site. The “Last Updated” legend above indicates when these Terms were last changed. At our discretion, we may also notify you of specific changes by emailing the email address associated with your Account. You are responsible for providing us with your current email address when you create an account and, if your email address changes, updating your account information to reflect your new email address. Your continued use of the Services, including by renting or purchasing Products (as defined below) from us, following any changes to these Terms will indicate your acknowledgment of such changes and agreement to be bound by the revised Terms. Any changes to the Terms will not apply to any dispute between you and us that arises before the date we posted the revised Terms incorporating such changes or otherwise notified you of such changes. If you disagree with the new Terms, you may no longer access or use the Services. 

Privacy

2nd Lane governs your submission of information through the Services. To review the current 2nd Lane Privacy Policy, please check our Privacy Policy.

ABOUT OUR SERVICES

How to Access 2nd Lane 

As noted above, you will need to be 13 or older to access or use the Services. To use the Services, you may be required to sign up for an account (your “Account”), select a password and username (your “2nd Lane ID”), and provide us with certain information or data, such as your contact information. You promise to provide us with accurate, complete, and up-to-date information and to maintain and update such information. You may not select as your 2nd Lane User ID a name that you don’t have the right to use or another person’s name with the intent to impersonate that person. We may reject the 2nd Lane User ID and password if you change any other information you provide to us when registering for an Account. You may not transfer your Account to anyone else without our written permission. You may only register one Account per Paid Service (as defined below).

Additionally, you may be able to access certain parts or features of the Services using your account credentials from other services operated by third parties (each a “Third Party Account”), such as those offered by Google, Instagram, and TikTok. By using the Services through a Third Party Account, you authorize us to access information from such Third Party Account for use in connection with the Services. 

You may only use the Services and Products made available to you for your own personal, non-commercial use, and not for or for the benefit of any third party, and only in a manner that meets all laws that apply to you. If your use of the Services or Products is prohibited by these Terms or any Additional Terms or applicable laws, then you are not authorized to use the Services or Products. You are solely responsible for any use by you of any Services or Products in violation of these Terms, any Additional Terms, or applicable law.

You may not share your Account (including your 2nd Lane User ID or password) with anyone, and you must protect the security of your Account (including your 2nd Lane User ID and password) and any other access tools or credentials. You’re solely responsible for any activity associated with your Account, including all charges incurred from using the Services with your Account.

For any reason, we may limit or restrict your access to or use of the Services, including, but not limited to, refusing to fulfill any order you place with us or restricting orders placed under a single customer account, payment card, or billing or shipping address. We reserve the right to limit, cancel, or prohibit any use of the Services for any reason in our sole discretion, including but not limited to availability and geographic concerns, or if we determine or suspect that you are using the Services for fraudulent or commercial purposes or any other purposes in violation of these Terms or any Additional Terms.

Cost of the Services

We may charge you to access and use certain parts of the Services (the “Paid Services”). We reserve the right to modify or waive fees required to use certain parts of the Services. You are solely responsible for (i) the fee for any Paid Services that you order and that are not canceled by our cancellation policy, (ii) the price of any Products that are not returned by our policies, and (iii) any late fees accrued by you due to late or lost items. 

For more information about our Services, including pricing fees and cancellation policies, please see our FAQ Section. Please note that any pricing, fees, and payment terms presented to you when using or signing up for a Paid Service are deemed part of these Terms.

Reserve

If you rent a Product through our Reserve Service, the rental fee (“Rental Fee”) will include rental coverage charges and shipping and delivery charges (as applicable) listed on the Reserve Service for your rental of the relevant Product, and you authorize us (or our third-party payment processor) to charge your Payment Method (as defined below) the Rental Fee. 2nd Lane reserves the right to alter the Rental Fee or availability of any particular item at its discretion and without notice.  

Requesting a Rental

Security

Mandatory checking identity 

We're building a trusted community for people to rent luxury and beautifully crafted items, so security is of the utmost importance to ensure everyone has a safe shopping use a third party to check the ID of everyone using the 2nd Lane platform, and this can include verifying your name and address taken from your passport or driving license and experience. 

After your booking, you will receive your contract and invoice, and we will request that you complete your personal information, such as address and phone number, in your 2nd Lane account. This is a crucial step to finalize your booking, as you accepted our Terms and Agreements when you finalized your booking.

You must sign and return the contract to us as soon as possible with a copy of your driver’s license or other acceptable photo identification (ID) confirming your address.

Other Terms Related to Products and Services 

Use of the Products 

You agree to treat the Products with great care. The rental coverage we provide covers normal wear and tear. Still, you are responsible for any loss, destruction, or damage to the Products for any reason, including theft, loss, mysterious disappearance, fire, major stains, or any other cause. “Normal wear and tear” means minor stains, rips, missing beads, stuck zippers, or other minor damage covered by the rental coverage. Suppose you return a Product that is damaged beyond normal wear and tear. In that case, you hereby authorize us (or our third-party payment processor) to charge your Payment Method for repairing or replacing the Product, as determined in our discretion, up to the Original Retail or Comparable Value price for the Product.

Security Bonds

Security Bond and Insurance - Terms and Conditions 

1. To ensure the preservation of our dress collection and provide a worry-free experience, we can require a security bond for each piece. The security bond acts as a refundable deposit and covers any significant damage, loss, or alterations beyond normal wear and tear.

2. Upon booking, a security bond can be charged to your card (50% of the price of the booking). The amount will be communicated and is subject to our discretion based on the piece's value.

3.  The security bond will be refunded promptly upon the piece's return in its original condition and on time, provided there are no damages or breaches of our terms and conditions.

4. Minor repairs, such as small tears or missing buttons, are covered by our $20 insurance per piece—please add one for each piece you want to insure. If you are booking more than one piece and pay just for one insurance, we will charge you when we provide the remaining pieces. This insurance ensures that if any minor repairs are needed, they will be taken care of without any additional cost to you.

5. In the event of significant damage, loss, or alterations beyond normal wear and tear, the security bond will cover the necessary repairs, replacement, or associated costs you will be responsible for the remaining amount if the security of these expenses bond. If the bond wasn't charged at the booking, we have the right to take the money out of your card.

6. Please note that the security bond and insurance are necessary to protect the quality and integrity of our collection. When proceeding with a rental, you agree to adhere to our terms and conditions.

7. Our team will assess any damages or breaches of our terms and conditions, and we will strive for fairness and transparency throughout the process. We may contact you to discuss the situation and resolve any issues.

8. Our team is available to address any questions or concerns you may have regarding the security bond, insurance, or any other aspect of our dress rental services. Please reach out to our customer support team for assistance.

9. We reserve the right to update or modify our security bond and insurance terms and conditions at any time. You are responsible for reviewing and understanding the most recent version before proceeding with a dress rental.

Rental Period 

The rental period you have selected for your rental is 'inclusive'. For example, a 4-day rental period can mean that your item will arrive by Friday and you will post it back on Monday. In this example, both the Friday and the Monday are included in the 4-day period.

Most rental periods start at a minimum of 4 days and can be as long as you and 2nd Lane agree. Please note that you will need to receive and return within a short period for short rentals, so please consider this when booking rentals.

We automatically apply a discount to bookings lasting more than 5 days. If you have longer travel plans, please contact us, and further discounts will be applied.

Delivery and returns

For residents of Sydney, you must book at least 24 hours before your first rent date. For interstate residents, you must ensure the items you are booking are available for at least three days before your first rent date. When we process your booking, we must block the dates necessary for delivery to your address. Express Shipping can take 1 to 2 business days.

Sydney based Pick up and Drop off

If you choose the pick-up option, you will be emailed with the address and time that your order will be ready to pick up and drop off when your rental period finishes. The times must be respected; otherwise, you will be charged proportionally for your late delivery.

NSW Express Shipping Delivery

If you choose the delivery option, and we are based in Sydney, you will receive the item on your first day of rental. For example, a rental between the 1st and 7th of June must arrive with the renter on the 1st and be sent back, at the latest, on the 7th of June to arrive the next working day. The time to pick up is 12 p.m., and the time to drop off is 10 a.m. Fees apply after the time. For residents of Sydney, you must book at least 24 hours before your first rent date. 

Interstate Express Shipping Delivery (PLEASE READ CAREFULLY)

2nd Lane covers the Express Post expenses for one way. The way to send it back is from the customer's responsibility.

For interstate residents, you must ensure the items you book are available at least three days before your first rent date. When we process your booking, we must block the dates necessary for delivery to your address. Express Shipping can take 1 to 2 business days. Please contact us if this rule doesn't apply, and we will help you find the best delivery option on the date you need.

You must expressly ship us back your order on the last day of your booking using the same package we sent you. 

My Item hasn't arrived in time

For residents of Sydney, you must book at least 24 hours before your first rent date. For interstate residents, you must ensure the items you book are available for at least three days before your first rent date. When we process your booking, we must block the dates necessary for delivery to your address. We need at least two business days to prepare your order and Express Ship It. So make sure you book your piece 3 days in advance, considering the availability of the piece, as the express delivery can take 1 to 2 business days.

If your item doesn't arrive on the first day of your rental, you should contact 2nd Lane immediately. 

As a renter, you are entitled to a full refund if your item does not arrive on time. However, to receive a full refund, the renter must return the item within 24 hours of delivery. A partial refund might be more appropriate if an item is returned later than this. If the item is kept longer than the number of days of the original rental, the 2nd Lane can charge you late fees.

If an item is delivered late and the renter keeps it for longer than the rental period, they are liable for paying late fees to the 2nd Lane and will not be eligible for a refund.

If you have spoken to us at 2nd Lane and cannot agree to the refund, please email contact [email protected] for support.

Late Fees

Suppose you do not return one or more Products (other than the Products that you purchased) by the Product Return Date (see the “Returns and Lost Items” section below). In that case, you at this moment authorize us (or our third-party payment processor) to charge your Payment Method non-refundable late fees for the days that we do not receive every Product that comprises such order up to the full Original Retail or Comparable Value of the Products (the “Maximum Late Fee” unless otherwise specified in the corresponding FAQ Section(s)  not returned to us plus applicable sales tax.  Please see our FAQ Section for the relevant Product Return Dates and the late fees charged for each day a Product is not returned. 

If 2nd Lane charges you and pay the Maximum Late Fee for a Product under this “Late Fees” section and as described in the corresponding FAQ Section(s), you are permitted to retain the Product; however, we do not make, and expressly disclaim, any warranties of any kind concerning the Product, and the Product is provided to you on an “AS IS” basis. For the avoidance of doubt, this “Late Fees” section shall not apply to the Rental Fee or fees paid or payable by you for the non-return of Return Packaging (as defined below), each of which will be charged separately from, and in addition to, any late fees. Payment of any late fees does not excuse your breach of these Terms.

My Rental doesn't fit

It is up to us to decide whether to offer refunds due to fit. If you are unsure about this, please message us before sending a request. 2nd Lane will not issue refunds due to fit if it has been made clear they do not offer this.

All listings should have an accurate size given by the 2nd Lane, and we encourage extra description if sizing may come up differently. Due to international sizing standards, if you have any worries about size, it is always best to contact us to ask.

Recommended fit policy:

While 2nd Lane can decide their fit policy, we offer full refunds minus postage and cleaning fees if the renter:

  • Sends the item back on the same day to 2nd Lane, with Next Day Delivery (2nd Lane and the renter can organize an alternative agreement between themselves);
  • Contact 2nd Lane to let them know the item has been returned and is unworn due to the fit. Provide 2nd Lane with the correct tracking details so they know it has been sent.

If a clothing item's fit or style has been misrepresented, you can raise a ticket for a refund directly to [email protected]. For any queries, please email [email protected]

All refunds related to fit will be issued as credits on the website with no expiry date. 2nd Lane is not able to transfer credits from refunds to cash.

Paying for your Rental 

Payment for your rental is held while it is being approved to ensure enough funds to fulfill the rental. If the rental is declined or expires after 24 hours, your funds will be returned to you the following day. If your rental is accepted, your payment will be made to 2nd Lane.

If you have an approved refund, this can take up to 8 working days, depending on your bank.

If your rental is canceled, the transaction is sometimes reversed. This means the original authorization drops off your statement entirely within a few days of the cancellation. There is no payment or refund; it will appear like the whole transaction never happened. 

*2nd Lane covers one insurance per piece ($20). Please ensure you pay insurance for the quantity of pieces you book. Otherwise, we will charge afterward the insurance for the pieces that weren't paid in the first booking. I.e. if you have booked 5 pieces and paid for up to 2 pieces insurance ($20), we will charge in your original payment method the insurance for the other 3 pieces ($40)

*2nd Lane covers one-way express delivery ($25). So you know, the last date of rent is when you need to return your order or express post it to us. Please, use the same package to send us your order back. The cost of the postage to send us back is your responsibility.

My rental has arrived in poor condition 

All items should arrive to you as listed by 2nd Lane. If there are any marks on the garment, these should be flagged upon arrival. If the item arrives with any marks or flaws not flagged by 2nd Lane, please send photos to 2nd Lane on the day the item arrives to agree on a refund.

If your item arrives in poor condition, please let us know and return it within 24 hours of receiving the rental.

You can then send a refund request to 2nd Lane. If the refund request is not responded to within 72 hours, please email [email protected] with the rental details and photos so we can help with a refund accordingly.

How to Request a Refund 

If you are looking to request a refund from 2nd Lane, you need to email us.

If there are any issues with your rental, you must return the item to 2nd Lane within 24 hours for your refund to be approved. If the item is kept for the entire rental period, 2nd Lane will not qualify for a refund per our terms and conditions. 

If you have requested a refund you believe is worth it and 2nd Lane has not responded to it within 72 hours, call or text us immediately for quick assistance.

All invoices, as agreed by users and 2nd Lane, are final. 2nd Lane will not support the refund of this payment, and users will not be able to retract such an agreement.

Postage type

Which postal or delivery service to use is up to you; we do advise using the below options:

We do advise using delivery that is Express Shipping next-day guaranteed, and fully tracked, and always ensure insurance cover is equivalent to the RRP of the item. If your rental is returned without the correct insurance cover, the renter will be liable for the cost of the item RRP.

Tips for safe postage

  • Make sure to always include a return address on all parcels. If the item cannot be delivered due to, for example, the address being wrong, it will be returned to the sender (you). If the postage provider does not have a return address, you might never receive the item, which will be considered undeliverable. Please check with your postage provider to see how to provide a return address for your parcel. If an item is lost during postage, you can compensate 2nd Lane. Most postage providers do not compensate when the item is deemed undeliverable.
  • Please send all items insured. If your item is lost or damaged during postage, it is the sender's responsibility to compensate you.
  • Ensure the 2nd Lane's address is correct and written clearly. If the address is illegible, the postal provider might return it to the sender, and the renter could be eligible for a refund.
  • Package rentals appropriately. Ensure all items are packaged well and protected during postage, especially for more delicate items.

Sundays and Holidays

When requesting and approving a rental, please ensure you factor in Sundays and any Holidays periods as postal services will take longer. If your rental ends on a Sunday and your chosen postal provider does not provide service on a Sunday, you must check with 2nd Lane before sending it back. Ensure this is the next-day delivery so it is swiftly returned to 2nd Lane.

The same applies if your rental has ended on a Holiday. You will need to communicate with 2nd Lane that you will return this the day after the Holiday with the next-day delivery.

If 2nd Lane is not happy about this, you will need to extend your rental request to the following day and return your item.

2nd Lane is not liable for postal fees or loss of item costs from any postal service. We can guide how to contact delivery services.

Returning your Rental

Depending on the agreement you have with 2nd Lane, you can make your return in two ways:

  • In-person return;
  • Express Postage/Delivered returns (one-way payment coverage).

Postage returns

All items should be posted back on the last day of rental with next-day delivery.

The renter is responsible for returning and paying for the item's postage. Therefore, we recommend sending all items tracked and insured to the item's RRP. If an item is lost or damaged during postage, the renter compensates 2nd Lane for their loss. If an item is insured, the renter can claim this cost back from the postage provider.

Please send 2nd Lane all tracking details and proof of postage as soon as the item is posted. Please follow 2nd Lane's instructions carefully.

Late Returns

If a rental is sent back later than the agreed rental dates, or not sent back using an appropriate postage method or incorrect address, 2nd Lane can charge a late fee as per our terms.

Sundays and Holidays

When requesting and approving a rental, please ensure you factor in Sundays and any Holiday periods, as postal services will take longer. If your rental ends on a Sunday and your chosen postal provider does not provide service on a Sunday, you must discuss this with 2nd Lane before booking and coming to an agreement.

The same applies if your rental ends on a Holiday. You'll need to talk to 2nd Lane to see if they're okay with you returning the item on the next working day or if you need to extend the rental period.

Altering your Rental

As the item needs to be returned exactly as it was received, you cannot make any changes. This includes but is not limited to the following:

  • Pinning
  • Addition of accessories
  • Dying
  • Cutting/Alteration of size

Cleaning 

We provide cleaning for all our garments, and we kindly request that you refrain from attempting to clean, alter, or iron/press them unless you have made prior arrangements with us.

While we steam all garments before sending them out, certain fabrics are prone to wrinkles and may become creased in transit.

This service is included in the rental rate for standard use, and we expect a level of wear and tear (ONLY FOR PIECES UNDER RRP $1000). 

However, if a garment is returned abnormally dirty and requires excessive cleaning beyond this standard level, dry-cleaning fees will apply, and you agree to pay up up to $70 per piece for professional dry cleaning. The dry cleaners contracted by 2nd Lane will clean all items to ensure the washing processes are followed.

2nd Lane mandates this for high-price point items over $1000 (RRP). The dry cleaning fee set by 2nd Lane is mandatory and will be provided by our specialist cleaning. You will be charged up to $70 per pieceTHIS AMOUNT WILL BE TAKEN FROM YOUR SECURITY BOND WHEN YOU SEND US BACK YOUR PIECES.

What if I accidentally stain or damage a rented item?

Please get in touch with 2nd Lane at [email protected]. When the item is received back, we'll carry out a condition report, assess the damage, and consider a suitable solution, whether laundering, repair, or an additional charge, in part or whole, from the renter as compensation to 2nd Lane for their loss.

If your damage is not repairable, you are responsible for replacing the piece with a brand new one without any compensation, paying back 2nd Lane the full price of the piece listed on our website (RRP), or buying a new piece from the original retailer. You have the right to keep the damage piece as soon as the brand new one is replaced to 2nd Lane.

Proof of condition

We would always recommend that you have proof of the condition of your rental.

This is good to have in case anything happens during the rental and a dispute arises. Without proof of condition, 2nd Lane cannot analyze any damage dispute.

What photos should I take?

As a renter, photos should be taken when you receive and return your rental.

Include photos of any pre-existing damage (if applicable) and show the item's general condition.

When you receive the rental

Take pictures of the day you received the item. Make sure to notify us of any undisclosed damage.

Before you return the rental

Please take pictures of the day you returned your item and notify us immediately if you accidentally damaged it during your rental.

Damaged/Soiled/Replacement Garment

You agree to treat our products like yours and treat them with the utmost care. 2nd Lane AUS offers damaged insurance, an add-on of $20 up to 2 pieces, and $35 up to 4 pieces, which you must purchase when selecting your hire outfit.

If a garment is returned damaged without conditions of use, the costs of a new piece will be passed onto the client in full (RRP). If a garment is returned partially damaged and abnormally dirty, seamstress and dry-cleaning fees can cost up to $200. These costs can be fully passed onto the client and deducted from your bond or charged from your original payment form.

Our Insurance option covers you for common and accidental damage and removable stains that may occur during your hire period

To select insurance coverage against minor and accidental damage, select 'yes' to the insurance option on the product's listing.

Please note carefully

Insurance does not cover damages that ruin a garment, making it unable to be rehired. If a garment is beyond repair, our terms and conditions will charge the total recommended retail price (RRP).

Insurance is only available when booking a garment and cannot be added after collection/dispatch of the garment. If Insurance is not purchased and the garment is returned damaged, you can be held liable for all repair costs incurred by 2nd Lane, including Mending Fees.

MAKE SURE YOU PAY THE INSURANCE FOR ALL THE PIECES YOU ARE RENTING; OTHERWISE, ONLY YOUR FIRST PIECE BOOKED WILL BE COVERED. 

Dry Cleaning Stains

Missed Hire Bookings due to damage/repair delays

At 2nd Lane, we know that accidents happen, and we want you to be relaxed and enjoy your event without unnecessary worry about minor or unexpected damage to your garment. Should damage occur, contact 2nd Lane as soon as possible. Take photos of the damage, include a brief description, and advise whether you have purchased insurance cover for your hire.

The garment must still be returned by your hire terms. Once the garment has been returned, we will assess the damage and apply for insurance. Should the garment be beyond repair, we will calculate any further charges per our terms and conditions.

All decisions on whether a garment can be repaired and re-hired will be undertaken in consultation with a seamstress/dry cleaner as necessary, and the decision of 2nd Lane is final and binding on the client. Suppose the garment gets lost, stolen, or damaged beyond repair, whether or not such loss, theft, or damage is attributable to any negligence, failure, or omission of the User. In that case, the User will be liable to pay for the replacement of the item.

2nd Lane advises the User to be extremely cautious if using fake tanning products or perfume. If fake tan stains a garment or perfume, damages the fabric, and prevents it from being rehired, 2nd Lane reserves the right to charge the User the replacement value of the item(s) subject to 2nd Lane’s assessment of replaceable value.

Cancellations/Refunds

If you need to cancel your hire at least two weeks before your booking date, you will be issued a credit note minus our $80 cancellation fee, valid for 12 months from the cancellation date.

For example, if your hire is $220, we will issue a credit note for $140. If you need to cancel your hire less than two weeks from the booking date, you will not be eligible for a credit note or refund.

In extreme situations, 2nd Lane will analyze the situation and deal with the client about a reasonable refund, considering the compensation for the late cancellation for 2nd Lane as one cancelation fee is the same as the loss of rental for that period.

Shipping Details

All parcels are sent via Australia Post and require a signature on delivery. It will be collective if you cannot sign it at the post. Your hire period starts when the courier attempts the first delivery, and credits will not be issued for late delivery if you cannot accept delivery. Once the item is signed for, responsibility and liability will be transferred to you. We do not take responsibility for orders where an incorrect or ineligible address has been provided. If you have provided an incorrect address, you will not be entitled to a refund or credit of any kind, and you may be liable for any late fees or a replacement fee if the dress is not returned to us. If you have supplied an address that has a redirection. We aim to minimize any potential postal delays by delivering your hires as soon as possible.

Please note that your delivery could arrive up to fifteen (15) days earlier than your selected delivery date. To ensure successful delivery, please provide a permanent address where the parcel can be left in a secure location or accepted by someone up to 15 days before your delivery date.

Any last-minute hires (orders placed less than 36 hours before being despatched) that do not arrive in time will be entitled to a credit note only and not a refund.

Orders placed after 2 pm AEST will be shipped the following business day. No refunds will be given for orders placed after this time that are not delivered by the following business day.

NOTE: A minimum of 2 days before your event must be selected if your hire needs to be shipped. We offer last-minute pick-ups from us in VAUCLUSE, NSW or Uber Parcel in Sydney.

Returns and Lost Items

Returning Rented Products: You agree to return each Product to 2nd Lane by the return date for such Product identified in your online account immediately when you “mark” an item as returning and the applicable invoice for your order or as otherwise outlined in these Terms (the “Product Return Date”). We may, but are not required to, permit you to extend your rental period for a Product (including by contacting us), subject to prepayment of any additional fees applicable to that Product for the extension period.   

Lost Items: We are not responsible for any personal or other items left in the Products or returned to 2nd Lane in the Return Packaging. If you believe you have accidentally or otherwise sent any such items to us, please contact customer service as soon as possible at [email protected]. We may, but are not required to, assist you in locating such items at your request, and we assume no responsibility or liability if we attempt to find such items. Failure to return a Product promptly violates our Terms, and we may terminate your Account, charge your Payment Method for Late Fees up to the Maximum Late Fee, and take other legal action.

Returning by Mail

If you use the 2nd Lane delivery fee, we provide one-way Express Shipping through Australia Post. You agree to return each Product to 2nd Lane by the return date through Express Postage using the same package you received at your own expense.

2nd Lane will not be responsible for loss, theft, or damage to Products that are shipped back to us, or for any fees or expenses that you incur due to delays in 2nd Lane receiving the Product.  

2nd Lane does not ship Products outside of Australia, and you may not return Products to us from outside of Australia without our prior written permission.

If you lose or damage the Return Packaging we provide, you will be responsible for returning the Product to us in your packaging at your own expense. 

Furthermore, you acknowledge that using any packaging or shipping carriers other than our Return Packaging and the carrier specified there may result in delivery delays and additional delivery fees for which 2nd Lane will not be liable. You will be solely liable for delays, Late Fees, additional delivery fees, and any damage to Products.

Billing and Payments

How Payments Work

When you place a rental order for a Product, you authorize 2nd Lane to charge your payment card or other payment instrument (“Payment Method”) for the Rental Fee. You must ensure that, at all times, your Payment Method is valid and up-to-date. You are responsible for providing complete and accurate billing and contact information to 2nd Lane and notifying 2nd Lane of any changes to such information. 2nd Lane will charge your Payment Method the amount of the Rental Fee immediately upon your rental order. A reservation of a Product through the Services is an order for the rental of that Product, regardless of how far in advance that Product is reserved. In addition, at the time of your rental order for a Product, you at this moment authorize 2nd Lane to charge your Payment Method for an amount up to the Original Retail or Comparable Value price of the Product set forth on the applicable Service plus applicable sales taxes; provided that 2nd Lane will only charge your Payment Method for an amount that is greater than the Rental Fee as described in these Terms. Rental Fees exclude all federal, state, and local taxes, goods and service tax, fees, customs, duties, levies, and other governmental assessments, all of which shall be paid by you directly or, if paid by 2nd Lane, shall be paid by you to 2nd Lane in connection with your rental order.   

We use a third-party payment processor (the “Payment Processor”) to bill you for any Paid Services through a payment account linked to your account (your “Billing Account”). By choosing to use Paid Services, you agree to pay us, through the Payment Processor, all charges at the prices then in effect for any use of such Paid Services by the applicable payment terms, and you authorize us, through the Payment Processor, to charge your chosen Payment Method. You agree to make payment using that selected Payment Method. Still, if the Payment Processor cannot charge your preferred Payment Method, you authorize us to use any Payment Method stored on record for your Billing Account. We reserve the right to suspend or cancel a rental order or terminate your access to the Services if we cannot successfully charge the provided Payment Method. We are not responsible for errors by the Payment Processor, and we reserve the right to correct any errors or mistakes that we or the Payment Processor make(s) even if we have or our Payment Processor has already requested or received payment. If we, through the Payment Processor, do not receive payment from you, you agree to pay all amounts due to your billing account upon demand.  

Information Provided by Customers

You must provide current, complete, and accurate information for your Billing Account. You must promptly update all information to keep your Billing Account current, complete, and accurate (such as a change in billing address, credit card number, or credit card expiration date). If your Payment Method is canceled for any reason (e.g., for loss or theft) or if you become aware of a potential breach of security, such as the unauthorized disclosure or use of your User ID or password, you must promptly notify us, and update your Payment Method. Changes to such information can be made in your account settings. SUPPOSE YOU FAIL TO PROVIDE ANY REQUIRED INFORMATION OR KEEP SUCH INFORMATION UP-TO-DATE. IN THAT CASE, YOU AGREE AND ACKNOWLEDGE THAT WE MAY CONTINUE CHARGING YOU USING ANY PAYMENT METHOD YOU HAVE ON RECORD FOR ANY USE OF PAID SERVICES UNDER YOUR BILLING ACCOUNT UNLESS YOU HAVE CANCELLED OR PAUSED YOUR PAID SERVICES OR TERMINATED YOUR ACCOUNT BY THESE TERMS.

Our Content

We and our suppliers and licensors own the Products and Services (including related software, code, data, and information relating to it), and proprietary methods and systems used to provide the Services (collectively, “Our Property”), the materials, text, graphics, data, articles, photos, images, illustrations, information, and other content made available or displayed by us through the Services (collectively, “Our Materials”), and certain of the trademarks, service marks, names, and logos, including, but not limited to, 2nd Lane (“Marks,” and together with Our Property and Our Materials, collectively, “Content”). You agree and acknowledge that the Content is (i) protected by copyrights, (ii) subject to other intellectual property and proprietary rights and laws, and (iii) owned by us or our suppliers and licensors. Except as expressly permitted in these Terms, Content may not be copied, modified, reproduced, republished, posted, transmitted, sold, offered for sale, redistributed, or otherwise used in any way without our prior written permission and the prior written permission of our applicable licensors. 

Subject to these Terms, and solely for so long as you are permitted to use the Services, we grant to you a non-transferable, non-sublicensable, non-exclusive, revocable, limited right and license to access and use the other aspects of the Services, in each case solely for your own personal, noncommercial use. You promise to abide by all copyright notices, trademark rules, information, and restrictions contained in or attached to any Content and that you won’t use, copy, reproduce, modify, translate, publish, broadcast, transmit, distribute, perform, upload, display, license, sell, commercialize, or otherwise exploit for any purpose any Content. You may not modify, publish, transmit, participate in the transfer or sale of, reproduce (except as expressly provided in these Terms), create derivative works based on, or otherwise exploit any of the Content or Services. You may not use our trade names, trademarks, service marks, or logos in connection with any product or service that is not ours or in any manner that is likely to confuse. Nothing contained on the Site should be construed as granting any right to use any trade names, trademarks, service marks, or logos without the express prior written consent of the owner.
